Article 4 of Law No. 45.18 establishes two legal modes of practice for social workers: salaried employment (أجير) and independent private practice (مستقل).

1Practicing as a Salaried Social Worker

A salaried social worker performs their duties under a legal employment relationship with a private-sector or non-profit employer (excluding civil service positions exempted under Article 5):

  • Main Categories of Employers:
    • Social Welfare Institutions (EPS governed by Law No. 65.15: child welfare residential centers, student boarding homes Dar Talib/Taliba, education and rehabilitation centers for persons with disabilities, residential care homes for older adults, emergency shelters);
    • Non-profit associations and public-utility associations (governed by Dahir No. 1.58.376 of November 15, 1958);
    • National and international foundations (Mohammed V Foundation for Solidarity, Mohammed VI Foundation for the Reintegration of Prisoners, corporate foundations, international NGOs);
    • Private schools and inclusive educational institutions (employing school inclusion assistants AVS/AESH in Category 13, special needs educators in Categories 6 and 7, or school social workers in Category 1);
    • Private clinics, dialysis centers, addiction treatment centers, and private rehabilitation facilities (employing medical social workers in Category 2);
    • Large private industrial and commercial companies operating an occupational social service (corporate social workers in Category 1).
  • Labor Code Protections (Law No. 65.99): Salaried social workers enjoy all statutory protections under the Moroccan Labor Code (written or permanent employment contract, minimum wage compliance, 44-hour standard workweek, paid annual leave, mandatory registration with the CNSS and compulsory health insurance (AMO), and protection against unfair dismissal). Employers must keep a certified copy of the employee's ICHHAD accreditation decision in their personnel file.

2Practical Guide to Setting Up an Independent Private Practice

The statutory recognition of independent practice allows an accredited social worker to open a private counseling, family mediation, or specialized educational support practice, or a consulting firm in territorial social engineering, and to bill professional fees.

A. Professional Categories Most Suited to Independent Practice

  • Social Worker / Family Social Investigator (Category 1): Social consulting office, assistance with administrative rights, corporate social audits, or private social assessments.
  • Special Needs Educator for Children or Persons with Disabilities (Categories 6 and 7) and School Inclusion Assistant (Category 13): Individualized socio-educational interventions in a private office, at home, or in schools under a written service agreement with families or educational institutions.
  • Family Support Worker (Category 12) and Elderly Support Worker (Category 14): Home-based family support, parenting guidance, and daily autonomy assistance for older adults.
  • Territorial Social Development Engineering Specialist (Category 18) and Social Development Officer (Category 17): Independent consultant or engineering firm conducting territorial diagnostics, social impact studies, INDH project evaluations, and capacity-building programs for associations, local authorities, or international donors.
